Terms of Service

These terms are an agreement between you and Physik (“we”, “us”) for your use of the Physik iOS and Apple Watch apps and physikapp.com (together, the “Service”). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use Physik

You must be at least 16 years old. You're responsible for your account and for keeping your password secure. Give us accurate information, and tell us at support@physikapp.com if you think someone else has accessed your account.

4. Your content

You own the data and content you add to Physik, such as workouts, routines, notes, measurements, and photos (“Your Content”). You give us permission to store, process, and display Your Content only as needed to provide the Service to you.

If you publish a routine to Explore, you also give us and other Physik users a non-exclusive, royalty-free license to view, copy, and use that routine within the Service. You can unpublish it at any time, though copies other users already saved may remain in their accounts.

You're responsible for Your Content and confirm you have the right to share it.

5. Acceptable use

Don't:

We may remove or unpublish content, and suspend or close accounts, that break these terms or put others at risk. Where reasonable, we'll tell you why.

6. Third-party services

Physik works with services we don't control, such as Apple Health, Apple Watch, the App Store, Hevy (if you choose to import from it), and Open Food Facts. Their own terms apply to them, and we're not responsible for their availability or accuracy. Food and nutrition data from Open Food Facts is provided by its community and may contain errors.

7. Our property

The Service, including its software, design, exercise library, and branding, belongs to us and our licensors. We give you a personal, non-transferable, revocable license to use the apps for your own non-commercial use under these terms and Apple's standard license terms for App Store apps.

8. Changes and availability

We're continually improving Physik and may add, change, or remove features. We aim to keep the Service available but don't guarantee it'll be uninterrupted or error-free. Keep your own copies of anything important; Pro members can export their workout history, and anyone can ask us for a copy of their data.

9. Ending your use

You can stop using Physik and delete your account at any time in the app (Profile → Delete Account). We may suspend or end your access if you break these terms, if required by law, or if we stop offering the Service. If we stop offering the Service, we'll give reasonable notice where we can so you can request a copy of your data.

10. Disclaimers

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions don't allow these exclusions, so they may not all apply to you.

11. Limitation of liability

To the fullest extent the law allows, Physik won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, or for personal injury arising from exercise or nutrition decisions you make. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $50. Nothing in these terms limits liability that can't be limited by law, including for gross negligence, willful misconduct, or, where applicable, death or personal injury caused by our negligence.

12. Indemnity

If you use the Service in a way that breaks these terms or the law and a third party brings a claim against us because of it, you agree to cover the reasonable costs and losses that result, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us at support@physikapp.com so we can try to resolve it informally. Any dispute that isn't resolved will be heard in the state or federal courts located in California, unless the law of the country where you live gives you the right to bring a claim in your local courts. If you're a consumer in the EU, EEA, or UK, you keep the protections of the mandatory consumer laws of your country.

14. Apple

These terms are between you and Physik, not Apple. Apple isn't responsible for the Service or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to it, except that if the app fails to conform to an applicable warranty you may notify Apple, which may refund the app's purchase price. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes to these terms

We may update these terms. If changes are material, we'll tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated terms.
